Including your family in the application

The announcement allows the spouse and certain children to apply together with the main applicant by proving the relationship and paying the amount set for their category.

Last legal review: · Responsible lawyer: Gastón A. Cejas

Who can be included in the application

Spouse

USD 100,000

Must prove the marriage. The amount is derived from the official example of a family of four (USD 500,000).

Children aged 18 to 25

USD 100,000

Only if unmarried and without children of their own, according to the announcement.

Children under 18

USD 25,000

Proof of parentage and, where applicable, consent of the other parent or custody documents.

How relationships are proved

Each relationship must be proved with civil-status records: marriage certificate for the spouse and birth certificates for children. Foreign documents must normally be apostilled (or legalised, if the issuing country is not a party to the Hague Apostille Convention) and translated into Spanish by a sworn translator registered in Argentina.

For children under 18 it will be necessary to show that both parents agree to the application, or to provide a court order or document attributing custody or parental responsibility. Adoption and stepchild situations must be analysed individually: the announcement does not refer to them expressly.

Questions the rules will have to answer

  • Civil partners. The announcement speaks of the spouse. It is not clear whether registered civil unions (uniones convivenciales) or foreign partnerships will be accepted.
  • Age at what moment. It is not specified whether a child’s age is assessed when filing or when the decision is made. A child who turns 18 or 26 during the process may change category.
  • Economic dependency. Some programmes require that adult children be financially dependent; the announcement mentions only being unmarried and without children.
  • Parents and other relatives. They are not mentioned. They may need to apply separately or use other migration routes.
  • Later additions. Whether a spouse or child can be added after the main applicant’s approval is not regulated.
